Terms and Conditions

These Terms and Conditions apply to all transactions for the sale of goods on this Moresque website. Please read them carefully before using the website and also read through our privacy and security policy regarding your personal information. They do not affect your statutory rights.

We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on the Website.

1. Prices and Descriptions

1. Although we endeavour to ensure that all pricing information on the Website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price. We will have the right to cancel or refuse any such orders whether or not the order has been acknowledged and your card charged. If your card has already been charged for the purchase and your order is cancelled, we shall issue a refund to the same card for the amount paid.

2. We reserve the right to adjust prices, offers, goods and specifications of goods on the Website at our discretion at any time before (but not after) we accept your order.

3. All prices on our website are in UK Pounds Sterling and exclude delivery charges.

4. Whilst we endeavour to ensure that the products we supply correspond as closely as possible to the samples described and displayed online, due to the nature of many of our products and photographic processes, there might be slight variations. These could include, but are not limited to, slight differences in shades, shapes, colours or dimensions of products. Please bear in mind that computer browsers, monitors, software and printers may present colours differently. No responsibility can be accepted for these variations.

5. We reserve the right to withdraw any goods from the Website at any time.

6. We will not be liable to you or anyone else for withdrawing any goods from the Website.

2. Orders

1. All orders made by you through the Website are subject to acceptance by us. We may choose to limit or not accept your order for any reason and will not be liable to you or to anyone else in those circumstances.

2. After submitting an order to us you will be sent an order acknowledgement email with details of the goods that you have ordered. Please note this email is an acknowledgement and is not an acceptance of your order.

3. All orders are subject to availability. For certain goods, information concerning stock availability is not available on the Website and could occasionally be out of date. If you order goods which are not available from stock, we will contact you and you will have the option to wait until the goods are available from stock, or cancel your order in accordance with our cancellation and returns policy. In the event your order is cancelled, we will refund any payment already collected from you in respect of that order, in accordance with our cancellation and returns policy.

4. Any email you receive acknowledging receipt of an order placed by you does not constitute legal acceptance by us of your order. Acceptance of your order and the formation of a contract between us will take place when we despatch the goods you have ordered unless we have notified you that we do not accept your order or you have cancelled it in accordance with our cancellation and returns policy.

3. Payment

1. Payment can be made using a variety of credit and debit cards (eg. Visa, Mastercard, Delta, Switch and domestic Maestro) or from a PayPal account. Payment will be debited from your account before despatch of the goods to you. All payments are processed directly by the 3rd party PayPal service, and taken in a secure environment which means that your card information is encrypted before being transferred for authorisation. You do not need a PayPal account to use this service. Please refer to PayPal’s terms and conditions for more details.

2. By placing an order, you confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment we will not accept your order and will not be liable for any delay or non-delivery, nor are we obliged to inform you of the reason for the refusal.

3. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.

4. Delivery

1. Most deliveries can be made within 7 days but please allow up to 28 days. In the event of unforeseen circumstances which delay your delivery, we will inform you accordingly. We cannot accept any liability for late deliveries which are due to circumstances outside of our reasonable control.

2. We can only accept orders from a UK billing address and can not accept overseas orders online. We are happy to accept overseas orders by phone provided that you arrange your own courier/shipping – please contact us to discuss this.

3. We can only accept online orders for delivery to addresses in the United Kingdom in England, Wales and Scotland excluding its Highlands and Islands. The following areas incur a postal surcharge not reflected in our online postage prices, and for delivery to these areas, please contact us to order and arrange delivery:

- Highlands & Islands of Scotland: Postcodes IV, HS, KA27-28, KW, PA20-49, PA60-78, PH17-26, PH30-44, PH49-50, ZE

- Northern Ireland, Isle of Man and Isles of Scilly: Postcodes BT, IM, TR21-25

- Channel Islands

4. Orders will be sent to the delivery address that you have specified. We cannot be held responsible if this delivery address is incorrect, or if your goods are signed for by another party.

5. Items will be delivered by Royal Mail or ParcelForce courier (although we reserve the right to use alternative means if considered appropriate). You will be required to sign for the receipt of your delivery. Therefore please ensure that someone is normally at the address to which you have requested your products be sent during working hours.

6. If the delivery address refuses delivery of the goods, or if you do not respond to any collection card that is left, your order will be returned to the sender and you will be charged for the return of the order.

7. The delivery charge for postage and packing is based on your total order amount. The charge is £5 for orders up to £35, and £7.50 for normal orders above £35. Very heavy or bulky orders may incur a higher charge - if this applies to your order you will be notified before your order is processed. Charges are per order per UK delivery address.

8. Ownership of the goods will only pass to you when we receive full payment, including delivery charges.

9. Once the goods have been despatched by us, all risk of damage to, or loss of, the goods shall pass to you. If you intend to cancel your order in accordance with the cancellation and returns policy, you must keep good care of the goods pending their return to us.

10. These terms and conditions do not apply once items are removed from mainland UK.

5. Cancellation & Returns

You may cancel your order at any time before your order has begun to be processed. If your order has been or is being processed, please follow the procedure below.

In the rare event that an item arrives faulty or damaged please contact us within 7 days and we will arrange a replacement or full refund as appropriate in accordance with your legal rights.

If for any other reason you are unhappy with an item, please notify us immediately and return the goods within 7 days and we will issue a full refund.

This is subject to the following conditions:

1. You are responsible for returning the item to us by post (we recommend you obtain a certificate of posting).
2. You will be responsible for the costs of return (unless the item is faulty).
3. The item must be unused, in its original condition and returned with its packaging.

Refunds will be issued to the card which was used to place the order once we have received the item back. Please note that we will not refund the initial delivery charges except if the item is being returned due to damage or a fault.

6. Security and Privacy Policy

7. Liability

To the fullest extent permitted by law and save as provided above, we shall not be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence for any indirect special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use by you.

Our entire liability under or in connection with any contract for any products to which these conditions apply shall not exceed the price of the products, except as expressly provided in these conditions. We will not be liable to you or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products ordered by you if the delay or failure was due to any cause beyond its reasonable control.

8. Severance

Each provision of these Terms and Conditions shall be construed separately and independently of each other and the validity of any one part shall not affect the validity of any other part.

9. Law

These Terms and Conditions shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.
